Lawyer of the Year. Best Lawyers in America honored Bob Wyatt in both 2013 and 2015 as Oklahoma City’s Criminal Defense: NON-WHITE COLLAR Lawyer of the Year and in 2014 as Criminal Defense: WHITE COLLAR lawyer of the year.

Among other crimes, we routinely defend:

Appeals

The Wyatt Law Office files appeals on behalf of clients in federal and state courts. Bob Wyatt is licensed in all Oklahoma appellate courts and in the U.S. Courts of Appeals for the 8th and 10th Circuits. He is also licensed to practice before the Supreme Court of the United States. Whether represented at trial by the Wyatt Law Office, we can file your appeal. For state criminal convictions, the appeal is filed with the Oklahoma Court of Criminal Appeals (the highest criminal court in Oklahoma). For civil appeals, the case is filed with the Oklahoma Supreme Court, which may refer the case to the Court of Civil Appeals. In federal court cases, the appeal is made to the regional appellate court. For Oklahoma, Colorado, Kansas, New Mexico, Utah and Wyoming, all appeals (civil and criminal) are filed in the U.S. Court of Appeals for the Tenth Circuit. The Wyatt Law Office also represents clients in extradition hearings, extraordinary writs (habeas corpus, coram nobis, mandamus, prohibition, etc.), defense of capital (death penalty) crimes, property forfeiture cases, and in appeals in both state and federal courts. In matters pending before the United States District Courts, the firm consults on or represents clients at sentencing or in related matters including but not limited to Motions for New Trial or Abatement, and Motions to Withdraw Guilty Pleas, sentence reduction matters (Rule 35), and applications for post-conviction relief (28 U.S.C. Section 2255).

An example of Wyatt’s work can be seen from the reversal of 106 counts in December 2003. Bob Wyatt was engaged to represent a northwest Oklahoma resident who had previously been convicted of 106 counts of uttering forged securities and engaging in illegal monetary transactions (effectively money laundering). The client sought habeas corpus relief for, among other things, ineffective assistance of his former trial counsel and conflict of interest. A new trial was ordered. After yet another conviction on those same charges in 2004, Wyatt appealed again, this time (in 2006) with the Tenth Circuit Court of Appeals directing a Judgment of Acquittal (“not guilty)– meaning that the client is a free man and the government cannot try him again. United States v. Hunt, 456 F.3d 1255 (10th Cir. 2006).

Please note that case results may vary because each case must be decided on its own unique facts and the law applicable to a given case. The cases set forth above and below are only representative samples of cases handled by this firm. You should not infer a probability of success on your case based on the results in the cases discussed below.

Asset Seizure and Forfeiture

The Oklahoma Legislature and the U.S. Congress have authorized the seizure and forfeiture of assets which are obtained with criminally derived proceeds, when the asset is used to facilitate a crime, or when the asset is a weapon or contraband. The best examples are the seizure of a car used to transport illegal drugs or the seizure of a farm used to grow marijuana. There are many grounds for seizure under both state and federal law. The standards are different for federal and state courts, so it is important to know what agency seized the property and to know the federal and state forfeiture laws. To forfeit the seized property under state or federal law, notice must be given to the owners and a due process hearing held before the ownerships can pass to either the state or federal governments.

The Wyatt Law Office has represented dozens of persons challenging the forfeiture and claiming innocent ownership of the property. There are several defenses to forfeiture depending on the circumstances. We can help you examine the issues, develop defenses and determine whether to pursue the assets in a forfeiture action or refer you to other counsel.

Child Porn

We defend charges of manufacturing, distribution, and/or possession of child pornography or obscene images in state and federal courts. All child porn charges are 85% crimes when charged in Oklahoma state courts, meaning that if convicted, the client will serve at least 85% of any sentence given. Also note that if convicted, the client will be required to register as a Sex Offender under the appropriate SORNA statute. Note that the punishment range for federal child pornography possession was recently increased. We have been very successful in defending these charges when the client has the resources and the “will” to fight. In most cases involving child porn allegations, we will need a computer forensic examiner and your full personal cooperation in order to defend the case.

Conspiracy Charges

Basically, a “conspiracy” is an agreement to commit a crime. The crime does not have to be completed so long as there is an agreement together with the commission of an “overt act” tending to support the crime. It is not necessary that the overt act itself be criminal. A conspiracy can be charged with any other crime — whether a drug crime, white collar crime, a violent crime or a theft crime.
