An example of Wyatt’s work can be seen from the reversal of 106 counts in December 2003. Bob Wyatt was engaged to represent a northwest Oklahoma resident who had previously been convicted of 106 counts of uttering forged securities and engaging in illegal monetary transactions (effectively money laundering). The client sought habeas corpus relief for, among other things, ineffective assistance of his former trial counsel and conflict of interest. A new trial was ordered. After yet another conviction on those same charges in 2004, Wyatt appealed again, this time (in 2006) with the Tenth Circuit Court of Appeals directing a Judgment of Acquittal (“not guilty)– meaning that the client is a free man and the government cannot try him again. United States v. Hunt, 456 F.3d 1255 (10th Cir. 2006).

The Oklahoma Legislature and the U.S. Congress have authorized the seizure and forfeiture of assets which are obtained with criminally derived proceeds, when the asset is used to facilitate a crime, or when the asset is a weapon or contraband. The best examples are the seizure of a car used to transport illegal drugs or the seizure of a farm used to grow marijuana. There are many grounds for seizure under both state and federal law. The standards are different for federal and state courts, so it is important to know what agency seized the property and to know the federal and state forfeiture laws. To forfeit the seized property under state or federal law, notice must be given to the owners and a due process hearing held before the ownerships can pass to either the state or federal governments.

There are several defenses to forfeiture depending on the circumstances. Basically, a “conspiracy” is an agreement to commit a crime.
